Starting January 1, 2026, you can sue a seller that violates the ban. You can file in circuit court where the offense happened or where any party lives. You may sue alone or for others like you. You can get back what you paid, up to $1,000 in punitive damages per violation, and your attorney’s fees and costs.
Starting January 1, 2026, Illinois bans at-home sexual assault evidence kits. These are kits sold for people to collect assault evidence themselves, not by medical staff. No one may sell, market, promote, advertise, or distribute these kits to consumers. The Attorney General or the State’s Attorney in the county where the purchaser lives can sue to stop sales and seek up to $1,500 per violation. If a State’s Attorney files a case, they must mail the complaint and any judgment to the Attorney General.
