Each state agency keeps in its rules a current description of its organization, with charts. Agencies also publish how the public can get information or make requests; asking for copies of rules is not a Freedom of Information Act request unless you say it is. Agencies keep tables of contents and other tools to help people find rules, and a clear description of how rules are made, with flow charts. Agencies also keep rules adopted under this section and related parts of the Act. These requirements have applied since July 23, 1997.
For internal-only rules that do not affect private rights, agencies can adopt by filing, and the rule can take effect right away. The agency gives at least 14 days of public notice, starting when it first appears in the Illinois Register, and the notice explains the proposal, why it meets this section, and how to send comments. During the notice, anyone can send written comments by email or the agency website; agencies may also take oral comments and must consider all input. After adoption, the notice explains any changes and may set an immediate effective date. The Secretary of State refuses filings that do not meet these notice and content rules.
