Stronger crackdowns on unlicensed and noncompliant dealers

If there is reasonable cause, the Secretary of State must issue a cease‑and‑desist order to stop unlicensed dealer activity right away; the person can contest it and a copy goes to the Department of Revenue. On a complaint from the Department of Revenue, the Secretary can refuse, suspend, or revoke a dealer license for tax failures, including not filing, filing a fraudulent return, not paying a final bill, or failing required bonds. The Secretary can also take license action if Motor Vehicle Franchise Act costs or fees stay unpaid more than 90 days after a second certified notice. Secretary of State Police can issue administrative citations; most penalties are up to $50 per violation and require at least three separate violations in one investigation, but some violations carry $1,000 to $3,000 per violation. Dealers and agents may not park vehicles to display them for sale on public property or general‑access private property, and police can tow any vehicle shown for sale with a destroyed, removed, covered, altered, or defaced VIN.

Online car sales and home delivery

Licensed dealers can sell vehicles over the internet and use electronic signatures. They can deliver to a customer’s address if the customer asks in writing and the dealer verifies the customer’s identity at delivery. Documents that must be signed in person can be signed at delivery without counting as an off‑site sale. For deliveries away from the dealer’s business, the sale date is when the buyer signs the title application.

Permits and fees for off-site sales and shows

Licensed dealers must get permits before off-site sales, display exhibitions, or trade shows. Off-site sale permits cost $25 per event, require an application before the sale, and do not allow Sunday sales; they are normally limited to the dealer’s market area except for motor homes. Display and trade show permits cost $10 each and last up to 30 days; new‑vehicle trade shows must include at least two licensed new‑vehicle dealers, and out‑of‑state dealers may participate. Dealers of trailers, manufactured homes, motor homes, mini motor homes, and van campers use a separate $25 permit for off‑site sales or trade shows. Out‑of‑state permits for those dealers issue only if at least two Illinois dealers join, and permits last up to 30 days.
