The law defines stalking as a course of conduct toward a person that causes fear or emotional distress. A “course of conduct” means 2 or more acts, including following, monitoring, surveillance, threats, unwanted contact, or harm to property or pets. It also covers use of electronic tracking or messages, and jail time for the actor does not stop a case. “Contact” includes showing up within sight, approaching, going to home, work, school, or worship, entering property, leaving items, or electronic messages. The test uses the victim’s situation and what they know about the respondent’s past acts. Lawful speech, assembly, and some lawful labor picketing are excluded. Harassment with no legitimate purpose that causes distress is covered.
The law defines “emotional distress” as serious mental suffering, anxiety, or alarm. Certain acts are presumed to cause it unless the respondent proves otherwise by a preponderance of the evidence. These include workplace or school disturbances, repeated calls after being told to stop, and repeatedly following or watching. They also include staying outside your home, work, school, or vehicle, peering into windows, threats to your child or family, and threats of force, confinement, or restraint.
A “petitioner” can be the named victim or the person filing for them. An authorized agent of an employer, school, or place of worship can also file. Courts can issue emergency or plenary stalking no contact orders. These orders can include the remedies the law allows.
