Beginning January 1, 2025, you may not market, advertise, or label ephedrine products for stimulation, mental alertness, weight loss, appetite control, or energy. The state reviews packaging, product name and labels, how you promote or distribute, and spoken claims to check compliance. A first violation is a Class A misdemeanor; a second or later violation is a Class 4 felony. This section does not change the Methamphetamine Precursor Control Act, which still applies.
Beginning January 1, 2025, some ephedrine medicines are exempt from state restrictions in Sections 312 and 313 if they meet strict rules. The product must be legal to sell over the counter, follow 21 C.F.R. § 341.76 labeling, be made to reduce abuse, and not be marketed for stimulation, mental alertness, weight loss, muscle enhancement, appetite control, or energy. Solid pills must follow 21 C.F.R. 341 and be in blister packs with no more than 2 tablets each; anorectal products may have up to 5% ephedrine. Dietary supplements that naturally contain ephedrine remain outside this section if the ephedrine is in an organic matrix and is 15% or less of the product’s weight. Prescription products given by a pharmacy or practitioner under a valid prescription are also outside this section.
