The Department must get the Board’s advice on all hospice and palliative care duties and rules. Any rule proposed on or after the amendatory law’s effective date is void if adopted without Board advice, except for emergency rules under Section 5-45. If the Department does not follow the Board’s advice, it must send written reasons before adopting the rule. The Board must review the rule’s economic and regulatory impact. If the Board does not advise within 90 days after being asked, the rule is treated as acted on.
The law creates a Hospice and Palliative Care Advisory Board. The state health director chairs the board but does not vote. Members include one doctor, one nurse, four hospice program nominees, two public members with no hospice ties, one consumer advocate, and nonvoting reps from three state agencies. The board meets at least four times a year; the chair must call a meeting if four members ask. A member may send a replacement with a letter if the replacement represents the same interests. Initial terms are staggered: four for 2 years, four for 3 years, and five for 4 years; after that, all terms are 4 years, and vacancies serve the rest of the term. Board members get paid back for actual expenses. The board also reviews pediatric palliative care issues under the Pediatric Palliative Care Act.
The Board must send a report to the General Assembly by December 31, 2026. It must include data on the need for and availability of hospice and palliative care in Illinois. It must show the value of non-hospice adult palliative care. It must give evidence-based education plans for providers and the public. It must also recommend state standards for adult palliative care.
