Who is covered by the transit benefits law

An employer is covered if it is in Cook County or listed townships in Lake, Will, DuPage, Kane, or McHenry Counties. It must have 50 or more covered employees at an address within one mile of fixed-route transit. A covered employee works an average of at least 35 hours per week for pay. Public transit means systems under the Regional Transportation Authority. A transit pass includes a pass, fare card, token, or voucher. These definitions apply beginning January 1, 2024.

Union contracts protected, construction exception

The law does not change a valid union contract in place on January 1, 2024. After that date, any waiver of this law in a union deal must be clear and explicit. For construction employers, the law does not apply to employees covered by a bona fide union contract. The law defines construction broadly, including building, repair, landscaping, snow removal, and refuse collection. These rules take effect January 1, 2024.
