Contracts made under this law are exempt from the state’s Public Contract Fraud Act. This lowers fraud‑act legal exposure for contractors on these projects. Oversight and enforcement instead rely on other laws and contract terms. This section is scheduled to be repealed on July 1, 2032.
The law lets the Transportation Agency use design-build, Construction Manager/General Contractor, and Alternative Technical Concepts for road and bridge projects. For Department projects, capital costs using these methods must not exceed $500 million of contracts awarded on an annual basis during the Department’s multi-year program for any five-year period. For Authority projects, use is capped at 20% of the Authority’s annual improvement program, and the Agency must calculate and post these limits before procurement. The Department may use CM/GC on up to two facilities per year. Before any design-build or CM/GC bid, the Agency must publish a best-interests analysis covering schedule, completion date, and costs. These authorities run through July 1, 2032, and the Agency reports yearly to lawmakers for the first five years after June 15, 2022.
