Limits on digital replicas replacing workers

Beginning January 1, 2026, some contract terms about digital replicas are not enforceable. This applies to new performances fixed on or after that date. A term is not enforceable if it lets a digital copy of your voice or face replace your in-person work. It must also lack a clear, specific description of how the copy will be used. And you had no lawyer who negotiated written license terms and no union contract that expressly covers digital replica use. If the use matches the contract and the basic character of the recorded photo or soundtrack, it still stands. Only the digital replica part is void. Other terms, including any exclusivity, still apply.
