If you got unemployment money without fault on or after 2020-03-08 and before the end of the state COVID-19 disaster period, the state can stop collection. You must ask for a waiver within 45 days of the date on the Department’s mailed notice. If approved, the state permanently ends recovery by lawsuit, recoupment, or withholding.
The Department must issue rules within 90 days after the law takes effect. The rules explain who qualifies for unemployment and how fraud is stopped, and must follow the federal law cited in the statute. By 2030-01-01, the Department must report how the mental-health exception affects the Unemployment Insurance Trust Fund.
For claims dated 2025-12-28 through 2028-12-24, you are not disqualified for quitting if a licensed psychiatrist says you cannot do the job due to a mental health disability and your employer cannot accommodate you. This expands eligibility only for that time window.
The Director can ask debit card issuers to return money from certain unemployment debit cards. For cards never activated with no benefit transfers in the last 12 months, funds can be returned. For activated cards with no transactions in 12 months, money can be pulled back if the person was found ineligible. Returned money goes back to the original fund and is capped at the ineligible amount plus any penalties.
