No school denial over immigration status

Schools and districts cannot deny a free public education or any school program because of a child’s or parent’s immigration or citizenship status. Schools cannot ask for immigration papers unless a law requires it, and cannot list status, birthplace, nationality, or national origin as directory information. Schools cannot threaten to share, or share, supposed status when they do not have direct knowledge, and may share real status with private groups only if student-records law allows it. These protections apply to charter schools. Information sharing that is required or allowed under state or federal law still applies.

Right to sue for school violations

Beginning July 1, 2026, anyone harmed by a violation can sue in court within two years. Courts can award actual money damages for willful violations and can order other relief. If you win, the court awards reasonable attorney fees, expert fees, and costs. You do not have to finish any administrative complaint process before going to court.

School rules for law enforcement visits

By July 1, 2026, each school adopts a policy to carry out these protections and set steps for law enforcement entry. Schools must name a reviewer, check judicial and nonjudicial warrants or subpoenas, watch and document all interactions, and notify parents or adult students about immigration‑enforcement requests unless a judge bars notice. For these rules, school resource officers are not treated as law enforcement agents. A nonjudicial warrant includes immigration detainers and civil immigration warrants, but not a criminal warrant issued by a judge on probable cause.
