The law requires officers to act fast to stop more harm in domestic incidents and to arrest when appropriate. If the alleged offender is a juvenile, officers may use diversion based on the full situation and must still send the report to the State’s Attorney if no arrest. Officers must provide or arrange rides to a hospital, a nearby shelter, or after court hours to the nearest judge so you can file an emergency order of protection. Officers must go with you to your home for a reasonable time so you can take needed belongings. They must give you accessible information, their name and badge number, one referral to a service agency, and advice on medical care and saving evidence like photos and damaged clothing. If you leave the scene, the law presumes minors or dependents stay with you or a person you choose, not the abuser.
If officers do not arrest after a good‑faith allegation, they must make a police report and note what happened. They must tell you how to request criminal charges and give times and places to meet the State’s Attorney, a warrant officer, or another official. They must also advise you to get medical care and to preserve evidence, including photos and damaged items.
If there is probable cause that certain weapons were used in the abuse, officers must seize and inventory those weapons, within constitutional limits. When the weapons are no longer needed as evidence, they must be returned to the person they were taken from, unless a court order or Section 24-6 of the Criminal Code says otherwise.
