Union and grievance rights for school staff

The law protects school employees’ right to organize, join, and assist employee groups. You can act together for bargaining, mutual aid, or protection, and you can choose not to take part (as Section 11 provides). When employees pick a representative for a proper unit, that representative bargains for everyone on pay, hours, and working conditions. You or a group can still present a grievance, but any fix must follow the contract, and the union must be allowed to be there.

Privacy rules for school employee data

Employers cannot share an employee’s home address (with ZIP and county), date of birth, personal phones, or personal emails. They also cannot share union membership or dues details, or emails between a union and its members. If anyone other than the union asks for this banned data, the employer must promptly give the union or the worker a copy or summary of the request and provide a copy of any response within 5 business days. If a disclosure is willful and wanton, you or your union can file a labor board charge or sue in circuit court where you live, work, or where the employer is. These limits do not apply to disclosures required by FOIA, needed for public operations or business, or made to the union.

Union access and employee lists at schools

Employers must give union reps reasonable on‑site access that does not disrupt normal operations. Reps can meet staff on the premises during the workday to handle grievances without charging anyone’s pay or leave. They can hold meetings at lunch, breaks, before, or after work, and use mailboxes and bulletin boards; a contract can allow more access, including email. Reps can meet each new hire for up to one hour within the first two weeks, unless both sides agree on a later time. Employers must also give the union an editable digital list (and send a copy to the statewide union) with names, job titles, worksites, home address, phones, emails, hire date, and ID if available. Send it within 10 calendar days after each school term begins, then every 30 days during the term, and within 10 days of each hire unless both sides agree otherwise.
