Bill Overview

Analyzed Economic Effects

3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Standard dementia assessments before and during stay

The Department sets a validated dementia assessment standard that scores the same across raters. A doctor must approve each resident’s assessment. The test happens before acceptance, every year, and after any change flagged by family, staff, or a doctor. Before admission, facilities use expert-approved, validated tools to check memory and thinking. Tools are reviewed and updated to match current best practices.

Stronger standards for dementia care units

If a facility offers a special Alzheimer’s or dementia unit, it must meet extra rules. It must give required disclosures to the state and to residents, and name a resident representative. It must have safety plans for wandering and evacuations, keep families informed, and provide cognitive activities. It must keep enough trained staff and require ongoing dementia training for leaders and direct care staff. It must keep emergency procedures and staffing patterns that meet residents’ needs.

Stricter assisted living rules for dementia

Assisted living and shared housing must refuse or discharge a person if they cannot provide or secure needed care. They must say no if services are not licensed or not offered, or if staffing is too low or lacks needed skills. They must not accept or keep someone if health or behavior has worsened so staying would harm them or others. They must not accept or keep someone who is dangerous when the danger cannot be removed with proper treatment. They also must refuse anyone who meets the barred conditions listed in Section 75(b)-(g) of this Act.
