Expanded prosecution for expressway crimes

Forcible felonies, gunrunning, or firearms trafficking on camera‑monitored expressways that are investigated by Illinois State Police can be prosecuted by either the Attorney General or the local State’s Attorney where the crime happened. This applies to camera systems funded by the Road Fund or Tollway funds.

More cameras on Illinois expressways

The State Police, IDOT, and the Tollway run a joint program to add cameras on expressways and State highways in 25 counties and along Jean‑Baptiste Pointe DuSable Lake Shore Drive in Cook County. They must post the program’s objectives and policies online within 90 days after June 3, 2022. Money for IDOT roads comes from the Road Fund; tollway roads use Tollway funds, subject to appropriation. By June 30 each year, they send lawmakers a report with installation and maintenance costs by county and how often images were used. The law repeals the program on July 1, 2025.

Rules for police use of images

Only trained, authorized law‑enforcement users can extract images from state and tollway cameras. Use is limited to active investigations of listed serious crimes such as vehicular hijacking, terrorism, motor vehicle theft, or other forcible felonies, and to highway safety and incident management. Images cannot be used to enforce petty offenses or other unlisted violations. Searches and monitoring cannot be discriminatory under state or federal law. Images loaded into a law‑enforcement database must be deleted within 120 days unless kept for an ongoing investigation or a pending trial. The law defines “authorized user” and offense terms.
