New rules for jury selection

Beginning January 1, 2026, courts follow a set process to pick jurors. At the start of a jury week, the clerk lists each summoned juror and keeps the names secure. When a jury is needed, the clerk, sheriff, or coroner draws names at random in court: 12 names, or 14 to 16 if alternates are needed. Lawyers have the right to be there when the names are drawn for their case, and must object before any juror is called for questioning or the objection is waived. Starting the same date, courts may use a computer to make the random draw. These changes apply to cases that start on or after January 1, 2026, and to cases still pending then.

Rules for jury strikes and alternates

Each side gets 5 peremptory strikes. If a side has multiple parties, the court may allow up to 3 extra strikes for each extra party on the side with the most parties, and both sides get the same total. If those parties cannot agree on how to split their strikes, the court decides. The court may seat 1 or 2 alternate jurors; they are picked and vetted the same way and replace regular jurors only before deliberations. If alternates are called, each side gets 1 extra strike that can be used only on an alternate; any unused regular strikes can also be used on alternates. Beginning January 1, 2026, these changes apply to cases that start on or after that date and to cases still pending then.
