Landlords and other plaintiffs may not name a person under 18 as a defendant in an eviction. A “minor” means under 18 unless a court has emancipated them. If a complaint names a minor at filing, the court dismisses the whole case for all defendants and seals the file right away. If someone willfully and wantonly names a minor, that minor is entitled to $1,000, reasonable attorney’s fees, and any actual damages.
Since August 1, 2022, a judge may seal an eviction file if the case lacks a factual or legal basis and sealing clearly serves justice. The judge must also find the public’s interest does not outweigh sealing. Courts must seal files for two eviction categories named in state law and for cases dismissed for naming a minor.
In an eviction case, a landlord can add a claim for unpaid rent, and the court may enter a money judgment. Hearings must stay focused on the eviction; unrelated claims or counterclaims are generally not allowed, except as provided in Section 9-120. If a case was dismissed because a minor was named, the landlord can refile against defendants who can be properly named. Courts cannot waive refiling fees; the plaintiff must pay normal court fees.
