The law sets Tier 2 pensions for police and firefighters who first joined on or after Jan 1, 2011. If you leave service at age 50 or older with at least 10 years, you get a monthly pension. It equals 2.5% of your final average salary for each year of service. It is cut by 0.5% for each month you retire under age 55. The pension is capped at 75% of final average salary. Final average salary is the higher of your best 96 months in the last 120, or your best 48 months in the last 60.
The pay used to set Tier 2 police and fire pensions is capped. Beginning Jan 1, 2011, the cap is $106,800. Beginning July 1, 2025, the cap is $141,407.74. After 2025, it rises each year by up to 3% or half the CPI‑U change, whichever is less. Benefits and employee contributions use the lower of your pay or the cap. No past employee contributions are changed.
The law sets survivor pensions for police and firefighters who first joined on or after Jan 1, 2011. A surviving spouse gets 66 2/3% of the member’s earned pension. If the member had at least 10 years but was not yet on a pension, the spouse gets the largest of: 30% of top patrolman or first‑class firefighter salary, 54% of the member’s monthly pay, or two‑thirds of a Tier 2 pension as if age 55. For 1.5 to under 10 years, floors of 30% or 54% apply. Children and guardians can get set shares (for example, about 12% per child or 20% for some guardian payments). If death is in the line of duty, added amounts can bring total survivor pay up to 75% of salary, subject to the Tier 2 salary cap. Survivor COLAs start Jan 1 after age 60 (or the first anniversary) and then rise each Jan 1 by up to 3% or half the CPI‑U change, with no increase when CPI‑U is flat or negative. Minimum widow protections are preserved.
If you are a child or parent who would qualify for a fire survivor annuity, you receive a Tier 2 child’s or parent’s annuity instead. It is paid the same way, but the pay used in the formula is limited by the Tier 2 salary cap. Family shares are based on the combined Tier 2 amounts. These rules apply back to Jan 1, 2011 and keep minimum protections.
The law exempts this Act from State Mandates Act payback rules. The State does not reimburse local governments for costs from these mandates.
