Stronger standards for wheelchair suppliers

Beginning January 1, 2026, sellers of complex rehabilitation technology must be accredited and employ at least one W‑2 qualified professional who is physically present for evaluations and device selection. Suppliers must be able to service and repair what they sell and must give you written repair contact information at delivery. They must offer service and repairs for the useful life of your wheelchair, with narrow exceptions for moving out of the service area, abuse or misuse when you refuse to pay, or safety threats. If a post‑service review finds a repair was not medically necessary, the supplier must pay and you and your insurer are held harmless. These rules apply to devices sold or in use on or after January 1, 2026, and violations are enforceable under the Consumer Fraud Act.

Post-mastectomy care in Medicaid and public plans

Starting January 1, 2026, Illinois Medicaid covers post‑mastectomy care and follows listed insurance protections. The Department adopts rules to ensure access. State employee plans and self‑insured county, city, and school plans must also cover post‑mastectomy care and follow the same Insurance Code sections. Home rule units must comply with every part of the law.

Quicker wheelchair repairs for Medicaid

For Medicaid managed care plans issued or renewed on or after January 1, 2027, repairs under $1,500 need no prior authorization or extra documents. For repairs of $1,500 or more, the plan must accept or deny the request within 7 days. Qualified suppliers must keep repair records and share them if the plan asks.

Faster wheelchair repairs in private plans

For plans issued or renewed on or after January 1, 2027, insurers generally cannot require prior authorization or extra paperwork for medically necessary repairs to your complex wheelchair. The rule has three limits: if the repair is under a manufacturer’s warranty, if total repairs are 75% or more of replacement cost, or if the device is within one year of a five‑year useful life. Your plan must also cover a rental device while your main device is being repaired. Starting January 1, 2026, HMOs, health service plan corporations, voluntary health services plans, and limited health service organizations must follow these rules; limited plans do not have to cover services outside their limited benefits.
