Beginning January 1, 2025, you receive timely notice of all court dates. You have the right to talk with the prosecutor about the case. You can speak at post‑arraignment hearings on release, pleas, or sentencing, and when your rights are at issue. Officials must tell you the conviction, sentence, imprisonment, and release of the accused. You also have a right to timely case resolution after an arrest.
Beginning January 1, 2025, you must be treated with fairness and respect, and free from harassment and abuse. Investigators cannot deceive you about evidence when you report a crime. You get notice and a court hearing before a judge decides on access to your private, legally protected records. If your DNA is collected because you are a victim, it cannot be added to DNA databases, except as allowed by specific state laws or FBI rules.
Beginning January 1, 2025, courts and police must reasonably protect you from the accused. Judges must consider the safety of you and your family when deciding release and conditions after arrest or conviction. You can be present at trials and other court events, unless the court finds your testimony would be affected. You may have an advocate or support person with you in court, subject to evidence rules. You can also hire a victim’s attorney for interviews, investigations, and other interactions, and officials cannot treat you differently for using a lawyer.
Beginning January 1, 2025, police must give you a written statement of your rights within 48 hours of first contact. The notice includes how to apply for crime victim compensation and local services, and you sign to confirm receipt. If you ask, the agency must give you a free copy of your police report as soon as possible, no later than 5 business days. The clerk must post crime victims’ rights within three feet of every criminal courtroom door.
Beginning January 1, 2025, you have a legal right to restitution in your criminal case. Courts must use existing procedures to order money owed to you.
