Beginning 2022-01-01, if there is credible evidence of serious abuse, the employee is barred from all contact with recipients. Serious abuse includes physical or sexual abuse, egregious neglect, material obstruction of an investigation, or financial exploitation of $20 or more. The ban stays in place until prosecution or discipline ends, or until the DHS Office of Inspector General’s final report finds the claim unsubstantiated or unfounded. For neglect, mental abuse, or money harm under $20, DHS sets steps while OIG investigates. Steps can include training, reassignment, a bar from the victim, a bar from all recipients, or discipline. “Credible evidence” means believable and reliable evidence about the incident.
Beginning 2022-01-01, these rules do not apply to employees of hospitals licensed under the Hospital Licensing Act, hospitals run under the University of Illinois Hospital Act, or hospital affiliates. These workers are not subject to the DHS OIG contact bars in this Section.
