The Agency can collect, store, and dispose of uncontrolled radiation sources that have entered the public domain. This applies when the Agency finds the source threatens health, safety, or the environment. This helps keep communities safer.
The Agency can bill actual costs to any person who owns, owned, possesses, or is responsible for radioactive material that entered the public domain. Costs can include collection, storage, and disposal. The law does not set dollar caps or a billing formula.
Since August 20, 2021, shippers and carriers moving irradiated reactor fuel in Illinois must give two notices. They must notify the Agency at least 7 days before and again 24 hours before transport. Notices must list the route, entry place and time into Illinois, and the amount and source. The Agency alerts the State Police, who notify county sheriffs along the route. This requirement ends January 1, 2027.
