Gun owners must lock guns or face fines

Beginning January 1, 2026, gun owners must lock guns or make them unusable when a child, an at‑risk, or a banned person is likely to get them. Carrying the gun or having it under your control counts as lawful storage. The rule does not apply if the gun was taken in an unlawful break‑in or used in lawful self‑defense. Penalties are up to $500, or up to $1,000 if such a person gets the gun. If the gun is then used to injure, kill, or in a crime, the fine can be up to $10,000, and the violation creates a presumption of negligence in civil cases. A judge may order community service or restitution instead, and penalty money goes to the Mental Health Fund.

More gun data and faster reporting

Beginning January 1, 2026, the Illinois State Police regularly publish reports on crimes with guns, including places, injuries or deaths, stolen status, seller, and more. The agency shares de‑identified data with researchers and law enforcement while protecting personal information. Courts, DHS, and circuit clerks must promptly report final rulings and involuntary admissions, and send twice‑yearly updates if there were no such cases. Doctors, police, and school officials must report clear and present danger within 24 hours; police must also report 24‑hour failures to report lost or stolen guns. At sentencing, courts must say if a listed stolen gun was used, and clerks must report that finding to the State Police within 5 days.

Easier FOID renewals and safety notice

By January 1, 2023, the Illinois State Police set rules so some FOID cards renew automatically during a transfer check if fingerprints are already on file. Beginning January 1, 2026, when a FOID card is issued or renewed, the State Police give a written notice in English and Spanish. The notice says you must report a lost or stolen gun to local police within 48 hours after you discover it; discovery means you have evidence the gun is missing.

Dealers face $2 fee and stolen-gun check

Beginning January 1, 2026, the State Police provide a phone or tech system so licensed dealers and gun show sellers can make transfer checks. The agency may charge up to $2 per inquiry. Fees go to the State Police Firearm Services Fund. Beginning January 1, 2027, those sellers must also check the State Police online list of stolen gun serial numbers before finishing a sale or transfer. New guns shipped directly from the manufacturer are exempt.
