Labs and police must destroy DNA samples and profiles taken from family members or personal items once the person is found. They may keep them only if a court issues a search warrant.
Police must decide right away if a missing person is high‑risk and reassess quickly when new facts appear. High‑risk factors include abduction, dangerous or unknown circumstances, medical needs, being under 21, or missing more than 30 days. Police must enter information into LEADS/NCIC immediately. If still missing, they must file a NamUs report within 45 days, or within 30 days for high‑risk cases; they may send a full packet and DNA within 30 days. The State Police must alert agencies statewide and in the region. Local police must use Amber Alerts for abducted children and the Endangered Missing Person Advisory when criteria are met.
All police agencies must accept a missing person report right away. No waiting period is allowed, and in‑person reports cannot be refused. Officers must collect key details and enter the case into LEADS immediately. They must tell the reporter how the case will be handled and share contacts for NCMEC (under 18) or NamUs (18+). Police may request photos, records, fingerprints, dental records, and voluntary DNA from the person or family. If the person is still missing 30–60 days after the report, police must add a NamUs record and try to get extra photos, fingerprints, dental records, and DNA. Biological samples collected for DNA must be sent to an accredited lab within 60 days so profiles enter state and national DNA systems. Police cannot close the case until the person is found or returned.
If someone other than the coroner has human remains, they must notify the county coroner right away; the coroner takes charge. Investigators must collect photos, X‑rays, fingerprints, and tissue for DNA to help ID the person. Do not cremate unidentified remains. Do not dispose of remains before key identification items are gathered. Deadlines: send fingerprints to fingerprint databases within 7 days; if no match, upload to NamUs within 60 days. Do a forensic dental exam within 45 days and upload to NCIC and NamUs. For skeletal or very decomposed cases, do an anthropology exam within 60 days. Send tissue for DNA to a NamUs partner lab within 30 days and send a DNA sample to a CODIS‑accredited or NamUs partner lab within 90 days of discovery. Report the remains and their location to Illinois State Police within 24 hours, and to the FBI within 72 hours if still unidentified. Before burial, assign a DNA log number and tag the remains and the burial container.
