The court can order any custodian or guardian to report on the child’s care. After a court citation, the custodian must give a full report within 10 days, in writing under affidavit, under oath in court, or as the court directs. After the hearing, the court may remove the custodian, appoint a new one, or return the child to a parent or former guardian. The court cannot remove a custodian or guardian without first giving notice and a chance to be heard, unless the custodian agrees.
A minor or any interested person may ask the court to change custody, appoint a new guardian, or return the child to parents or a former guardian. Wards can file a mandamus complaint to make a public agency follow this Act. If the youth is 18 and the guardian or custodian petitions to end guardianship or custody, it ends 30 days after the court gets the petition unless the court orders otherwise.
For youth committed under Section 5-750, the juvenile justice department must notify the court in writing within 10 days of key events. These include any critical incident (like serious injury, hospitalization, alleged abuse, or escape), a youth released but kept only due to no approved host site, and a youth (with listed exclusions) held more than one year. If held over a year is reported, the department must file an update every 6 months. Each notice includes a short description, the youth’s current health status, and actions taken. The court may then require a full report.
The Independent Juvenile Ombudsperson gives a copy of any required court report to the child’s guardian ad litem and attorney when the department has written notice of those appointments. If the department has a record of a guardian and a last known address, the Ombudsperson notifies the guardian that the report is available. If there is no guardian record but the department has parents’ addresses, the Ombudsperson notifies the parents that the report is available.
If DCFS is the child’s legal custodian or guardian, DCFS files updated case plans every 6 months. Any agency with guardianship must file a supplemental petition within 18 months of the sentencing order and every 18 months after, with facts on the child’s health and placement. The clerk mails 10 days’ certified notice of the hearing to the custodian, the child, and other parties unless they waive notice. When a child is in DCFS custody under this Act, the court holds permanency hearings on the schedule and rules set in the law.
