The Department of Labor can investigate agencies anytime and must investigate complaints. It will run a public complaint system and can inspect sites, subpoena records, and question witnesses. After notice and a hearing, it can order an agency to stop violations and go to court for an injunction. Civil penalties can reach up to $10,000 per violation, plus costs and attorney fees, and must be paid to the Department. Giving false or misleading application information can be fined up to $500 and is also a petty offense with a $500 fine. Ending a violation does not erase penalties already owed.
If your nurse staffing agency did not pay you 100% of the hourly wage set in its contract with a health care facility, it owes you that shortfall plus 5%. For example, a $100 underpayment means you get $105 back.
Nurse agencies must be licensed by the Illinois Department of Labor to operate or advertise. Health care facilities cannot use unlicensed agencies. A separate license is needed for each location, unless the added site is owned and managed by the same applicant. Applications are filed under oath and include a fee set by the Department. Agencies must show liability insurance of at least $1,000,000 per incident and $3,000,000 total, and carry workers’ comp for all nurses and CNAs. Home health agencies that act as nurse agencies must also get this license.
