Court-ordered patients get cross-state care

The law lets Illinois and Eastern Iowa treat people under involuntary court orders. It covers orders from Rock Island County, IL, and the Eastern Iowa Mental Health Region (Cedar, Clinton, Jackson, Muscatine, Scott). People in criminal cases are excluded. The sending state keeps legal custody and the sending court keeps legal control. A receiving facility must agree before any transfer. Except in emergencies, the facility cannot transfer, remove, or furlough someone without the sending authority’s approval. Valid sending‑state inpatient orders are honored and cannot be challenged in Illinois courts in the pilot area. Care is provided while the court order lasts, and patients are returned to their home state at discharge.

Cross-state program is law, ends 2026

The law makes the earlier pilot part of state law. But it sets a repeal date of January 1, 2026. The cross‑state admission rules stay in effect until that date unless extended.
