After family military leave or funeral honors leave, your employer must return you to your job or an equivalent job. The job must have the same pay, benefits, seniority, and terms, unless the employer proves the reason is unrelated to your leave. You can keep your benefits during leave by paying the cost, and your employer may agree to pay instead. You do not lose benefits you earned before the leave, and union or benefit plan rules that give you more still apply.
If your employer has 51 or more employees, you can take paid leave to serve on a veteran’s funeral honors detail. You must be trained and be a current or retired service member, reservist, Guard member, or an authorized provider with a veterans group. You get up to 8 hours per month and up to 40 hours per year, paid at your regular rate. You can use this leave without using your vacation, sick, or other leave first. Give reasonable notice, and your employer may ask the veterans group for proof. If you work in nursing homes, assisted living, or other 24/7 care sites, your employer can deny leave if staffing would fall below minimums or harm safety, but not if that breaks a union contract.
