Beginning August 8, 2023, when the court returns your child and orders public services, the Department of Healthcare and Family Services pays for those services. If the court keeps DCFS custody, DCFS pays, Family Support Program services are declined, and the child is no longer eligible for that program. This ties funding and eligibility to the court’s custody decision.
Beginning August 8, 2023, your child keeps their Family Support Program eligibility review. This applies when a petition says the child was left at a psychiatric hospital beyond medical need and an application with the Illinois Department of Healthcare and Family Services was pending or under review when the case was filed. If the child is eligible and services are available, the court holds a hearing within 14 days after all parties are told. The judge decides whether to return the child to you with services or keep DCFS custody. For temporary DCFS custody, the court checks urgent need; for DCFS guardianship, it checks if you can safely resume custody and if return is best for the child.
Beginning August 8, 2023, some cases are excluded from these Family Support rules. The law does not apply when a petition alleges other abuse or neglect and the adjudicatory hearing is not done. It also does not apply once a child is adjudicated abused, or adjudicated neglected unless the main reason was being left at a psychiatric hospital beyond medical need. It also excludes a child in DCFS temporary custody who, within five years, has an indicated abuse or neglect finding (not psychiatric lockout) naming the respondent as the perpetrator.
