Broader bargaining rights for public workers

Public employers and unions must meet at reasonable times, including before budgets. They must bargain in good faith on wages, hours, and other work conditions not excluded by law. The duty covers topics not addressed elsewhere, and contracts can add or implement rules tied to other laws. Either side must put the agreement in writing if asked.

Faster first contracts for small units

For newly certified public units with fewer than 35 workers (not including police, fire, or security), talks start fast. After a written request, the employer must meet and start bargaining within 10 days. If no agreement in 90 days, either side can ask the Labor Board for mediation. If mediation fails within 30 days (or a set extra time), either side can request arbitration under impasse rules. The right to strike remains until the arbitration hearing begins.

Limits on bargaining for home care workers

If you are a personal assistant or individual maintenance home health worker in the State Home Services Program, you can only bargain over matters the State controls. The law defines these limits. You cannot bargain over items outside State control.

Limits on bargaining for child care providers

If you run a child or day care home and take Child Care Assistance payments, you can only bargain over matters the State controls. The law defines these limits. You cannot bargain over items outside State control.

Rules to change public union contracts

A party seeking to end or change a contract must give at least 60 days’ written notice. That party must offer to meet and bargain and, if no deal is reached, notify the Labor Board within 30 days after the notice. All current terms stay in place, without strike or lockout, for 60 days after the notice or until the contract expires, whichever is later. These meeting, notice, and continuation duties stop if the Board certifies a new exclusive representative for the unit.
