Bill Overview

Analyzed Economic Effects

5 provisions identified: 3 benefits, 1 costs, 1 mixed.

20% yearly write-off for buses

Owners of vehicles used to transport students under this law can deduct 20% of the vehicle’s cost each year for five years. This write-off follows Section 29-5 of the School Code and lowers taxable income.

Safer vehicles for noncurriculum trips

For school trips that are not required and not part of a class for credit, schools must use limited vehicle types. Students in grade 12 or below may ride only in: a school bus; a vehicle built for up to 10 people including the driver; or an MFSAB built for up to 15 people including the driver.

Districts must insure student transport

School districts that provide transportation under this law must carry insurance. The insurance must cover losses or liability from the vehicle’s maintenance, operation, or use.

More bus options for learning trips

Students in grades 9–12 can ride in a multifunction school activity bus (MFSAB) for curriculum or career trips. The driver must have a valid school bus driver permit, and the bus must follow Illinois Vehicle Code Sections 6-106.11, 6-106.12, 12-707.01, 13-101, and 13-109. These buses cannot run regular routes between home and school. For curriculum or career activities, students in grade 12 or below must ride in a school bus or another listed vehicle; MFSABs are allowed only under these conditions. The law defines curriculum and career trips to include home-to-school trips, shuttles between schools, visits to colleges, job sites, vocational centers, regional safe schools, and trips that earn course credit. K–12 students with an IEP that requires a 1-to-5 staff ratio at Acacia Academy, Alexander Leigh, Marklund, Helping Hands Center, Connections Organization, Soaring Eagle Academy, or New Horizon Academy may also use an MFSAB for curriculum or career trips under the same rules.

Pickup trucks allowed for farm activities

If a student takes part in an agrarian-related activity, they may ride in a second-division pickup truck registered under Section 3-808.1(b)(7). The truck must weigh 12,000 pounds or less and have an enclosed cab with seatbelts for up to six passengers. This does not allow pickups for parades, homecoming, or similar noncurriculum events.
