Beginning 2025-07-01, if you miss a court date for a fine-only traffic offense, the court enters a conviction without you and adds the set assessment plus any statutory fine. If the charge can carry jail time, the court enters a failure-to-appear order. When the Secretary of State gets that order, your driver’s license is suspended right away, and no permit is issued. The suspension stays until you appear and resolve the case. After you do, the clerk gives you a sealed notice of compliance and tells the Secretary to clear it.
Beginning 2025-07-01, if your license was suspended between 2020-01-01 and 2025-06-30 for a fine-only offense that did not involve a death, you qualify for relief. By 2025-10-01, court clerks must report these old cases to the Secretary of State. By 2026-01-01, the Secretary must rescind those suspensions without any action from you.
Beginning 2025-07-01, court clerks may send new court-date notices by text, email, or phone using your last known contact. Every continued-date notice must warn that missing court could lead to an arrest warrant and affect your driving privileges.
Beginning 2025-07-01, Illinois uses state court rules for pretrial release and appearances for people from states not in the Nonresident Violator Compact. Suspensions issued under the Compact do not change under this law.
