Cemetery donations and care rules

The cemetery board can accept gifts or legacies of $50 or more for lot care or cemetery upkeep. The board may sell donated property, invest the money as the township authorizes, and use the income forever for the stated care. A gift made to the cemetery by name goes to the board, even if the cemetery is not incorporated.

Township cemetery boards and terms

The law lets the township collector, or the supervisor if there is no collector, appoint a three‑person cemetery board when the township owns or controls a cemetery. Members serve two years and stay until successors are appointed. After appointment, the board chooses a president and a clerk, and selects a treasurer.

Cemetery treasurer must post bond

Before starting, the board treasurer must file a bond conditioned on faithful performance and accounting. The bond must be at least twice the value of the money or property the treasurer will handle. The township collector, or the supervisor if none, approves the bond form and sureties, and it is kept like a village treasurer’s bond.
