CMS now has a police and security force. Officers are peace officers while on duty and can arrest or cite violations. In counties over 1,000,000 people, they act to protect state property or when asked by other police. In smaller counties, their powers apply only on CMS‑managed property to protect state interests.
DCFS and DHS decide how much space is needed for direct care at their facilities. CMS must consult them before leasing any surplus space. Leases cannot threaten the agencies’ ability to provide care.
Most sale money from surplus property goes to the General Revenue Fund. If a special fund paid for the property, that fund is repaid first. Net proceeds from closed state mental health facilities go to the Community Mental Health Medicaid Trust Fund. Net proceeds from closed developmental disability facilities go to the Community Developmental Disability Services Medicaid Trust Fund.
Each agency must file a property use report by July 31 each year. By October 31, the Administrator gives lawmakers and agencies a list of surplus properties. By February 1, the Administrator reports the year’s surplus property transfers and sales.
CMS now manages and leases state buildings and land. Most leases are capped at 5 years unless the law allows longer. Parts of 115 South LaSalle and commercial areas in the Thompson Center can be leased for up to 15 years, with renewals. CMS can also rent space for up to 30 days when it does not disrupt state work. CMS may charge fees for using these spaces, and the money goes to the Facilities Management Revolving Fund.
If a property is under $5,000, no appraisal is needed. At $5,000 or more, two appraisals are required and the average sets value. Sales below that value need a public written reason and review by the Executive Ethics Commission, and no sale can be below 75% of value. Local governments get at least 30 days to show interest and 30 more days to negotiate. Public auctions need three newspaper notices 15–30 days before, plus “For Sale” signs. Transfers use quitclaim deeds unless the legislature allows another deed.
