If someone knowingly files a fake or altered deed or other document that clouds or transfers your title, you can sue them. You can ask a court for money or other orders.
Beginning January 1, 2024, county recorders can run a fraud review and send suspicious deeds to a judge. They record a public Notice of Referral and must call and send certified mail to the last owner and the property address. The recorder also notifies the state financial regulator and may work with police. Hearings are set fast: scheduled within 10 business days and held within 30; the recorder files the judge’s order within 5 business days, and if fraud is found, it states the document is fraudulent and does not affect the chain of title. Courts can review the recorder’s referral decision from scratch. In counties under 3,000,000 people, recorders give 90 days’ public notice before starting this process. Recorders can use listed red flags (like altered forms or fake gold-or-silver payment claims) to spot suspect filings. These rules apply to filings recorded on or after January 1, 2024.
Every county runs a property fraud alert system that notifies you when a document is recorded for your property. You can sign up yourself, or a licensed agent can register you with a standard form. The form must say sign‑up is optional, list any cost, and let you add up to three extra contacts. Only licensed agents who register with the recorder can file these forms; the recorder keeps a list. When the recorder gets a signed form, they must enter it so alerts go out. Local home‑rule forms cannot conflict with the state form.
Beginning January 1, 2024, county recorders and their staff are not personally liable for mistakes in the fraud‑review process, unless their conduct is willful or wanton. This protection covers decisions to refer, review, or not refer a document.
The law limits when you can collect damages from counties, recorders, vendors, or real estate pros for registration or alert failures. You can still sue if they acted with willful and wanton misconduct.
Beginning January 1, 2024, if a recorded document is ruled fraudulent under this process, the recorder keeps the filing fee. The fee is not refunded to the filer.
