The law does not stop police from enforcing criminal trespass laws. Officers can still remove people or property when trespass occurs. This applies starting July 9, 2021.
The law lists when owners can get property back. It covers forcible entry, peaceable entry with possession held without right, unlawful entry into vacant property, staying after a lease ends, a buyer who defaults and refuses to leave after a written demand, and a grantor who will not surrender after redemption and demand. For installment home sales made on or after July 1, 1987, if the unpaid balance at filing is under 80% of the original price, the case goes under the mortgage foreclosure law. These rules apply starting July 9, 2021.
In condos, the board can seek possession if an owner does not pay common costs or fines after a proper written demand. It also applies when a lessor-owner or renter breaks leasing rules and the board has served the required demand. In common interest communities (HOAs), the association can seek possession for unpaid regular or special assessments after it serves the required demand. These HOA remedies only apply if the group is a not-for-profit or an LLC, owners can attend board meetings like condos, and the board voted after the 1984 amendatory act and sent notice; or if the declaration was recorded after the 1985 amendatory act. Some condo board rules (parts (c)–(h) of Section 18.5) also apply to HOAs when the board elects coverage or the declaration was recorded after 1985. The law defines community terms like declaration, unit, and association. These rules take effect July 9, 2021.
