The law explains key words in the Code. “May” is permissive. “No person may …” means no one is required, authorized, or allowed to do it. “Shall” is mandatory.
The law defines who is a cadet or candidate. It covers students in State officer‑training programs. An enlisted member is anyone holding an enlisted grade. Duty status other than State active duty includes service under written Title 32 orders and regular Inactive Duty Training. A day runs 12:00 a.m. to 11:59:59 p.m., and punishments in days are counted as successive duty days when not during annual field training.
The law defines classified information for Illinois military matters. It covers information a U.S. or State official marks as protected for national or state security. It also includes restricted data under the Atomic Energy Act.
The law clarifies who can bring and run military cases in Illinois. An accuser is someone who signs charges, orders another to sign, or has a private stake. Only commissioned or warrant officers are commanding officers; officers in charge count only for Article 15 punishment. The convening authority can be the original, the current commander, or a successor. A military court is a court-martial or a court of inquiry, and a military judge is detailed under Article 26. Judge advocates must be licensed lawyers and certified; another force’s senior judge advocate may certify when none are available.
Commissioned officers, cadets, and midshipmen are punished as the court‑martial directs if convicted of conduct unbecoming an officer and a gentleman. This rule applies under the Illinois Code of Military Justice.
