Starting July 1, 2026, the law tightens who is out of bargaining units based on job duties. Supervisors are those who mainly do different work than subordinates and use independent judgment over hiring, firing, discipline, or similar actions. For police, rank alone does not decide supervisor status; State Police at Major or above are supervisors. Fire company officers who meet the test are out of the fire fighter unit. Managerial employees are defined by real executive duties and now include an undersheriff, chief deputy, and jail superintendent unless the sheriff and union agree otherwise. Confidential employees with access to bargaining strategy, and short‑term employees (less than two straight calendar quarters in a year with no reasonable rehire assurance) are also excluded.
Starting July 1, 2026, a bargaining unit set by the Board generally cannot mix supervisors and non‑supervisors, and cannot be supervisors‑only, except for listed public‑safety exceptions. Employers may choose to let supervisors form and bargain in their own unit. Court reporters are placed into three specific bargaining units. The law also defines craft employees to include journeymen, crafts people, apprentices, and helpers, which can shape craft‑specific units and representation.
Beginning July 1, 2026, the law sets who counts as a public employee and a public employer. It includes interns and residents at public hospitals, and treats some caregivers as State employees for bargaining only on set dates: personal assistants (7/16/2003), child and day care home providers (1/1/2006), and some home care and home health workers (1/29/2013). It says these caregivers are not in the State Employees Group Insurance Act unless stated in law. The law defines the Board and which Panel handles your case, what “collective bargaining” covers (hours, wages, and conditions), and who can be the exclusive representative. It also keeps certain listed union certification petitions active for processing.
Beginning July 1, 2026, jobs that, if stopped, would create a clear and present danger to health or safety are essential services. Being marked essential can limit your right to strike.
Starting July 1, 2026, contracts may require nonmember employees in a bargaining unit to pay a fair share of bargaining and contract costs. The fee cannot be more than regular union dues. It cannot include any money for political contributions. Political giving stays voluntary.
Beginning July 1, 2026, the law names the public employer for court reporters. In Cook County, it is the chief judge. In the 12th, 18th, 19th, and, on and after December 4, 2006, the 22nd circuits, a group of those chief judges acts by majority vote. In all other circuits, a group of the chief judges acts by majority vote.
Beginning July 1, 2026, the law clarifies who counts as a fire fighter under this Act and who is excluded (such as volunteers, part‑time staff, clerks, and dispatchers). It excludes peace officers above captain in cities over 1,000,000 people. It defines security employees as those who supervise and control inmates; if most workers in a unit do that, non‑security staff in that unit can also be treated as security employees.
