No carbon storage in sole-source aquifers

Starting July 18, 2024, carbon storage is banned in facilities that sit on, under, or cross a sole source aquifer. This protects drinking water in EPA-designated areas. The Illinois EPA can still deny permits elsewhere to protect water.

Public study of Mahomet Aquifer safety

The law creates the Mahomet Aquifer Advisory Study Commission. Meetings are open to the public and held in the region; the University of Illinois helps run it. Members serve unpaid 3-year terms and choose a chair within 90 days of the law’s start. If funded, the Prairie Research Institute files yearly status reports by December 31, 2027 and each year after, and a final study by December 31, 2030. The Commission sends final findings by December 31, 2031 and ends January 1, 2032.

New permits for carbon storage projects

Beginning July 18, 2024, carbon sequestration in Illinois needs an Illinois EPA permit. Projects already permitted by the U.S. EPA before that date are exempt. It also exempts Class VI wells with a U.S. EPA completeness finding before January 1, 2023, when capture and injection are on contiguous, commonly owned land. Operators must follow the law, Board rules, and permit terms, and file all required reports. Where needed, they must also get a pore-space integration order from the Department of Natural Resources.

Defines terms for carbon storage projects

The law defines key terms for carbon capture and storage, like carbon dioxide stream, injection, and sequestration facility. It says a sequestration facility does not include CO2 pipelines. It defines “project labor agreement” and what such agreements include, like wage and benefit terms and hiring goals. It also defines “sole source aquifer” using EPA designations as of March 19, 2015. These definitions take effect July 18, 2024 and set who and what is covered.
