New rules to outsource school support jobs

Beginning July 1, 2026, school boards can hire private companies for non‑instructional jobs now done by district staff. A contract cannot start until the current union contract ends, and any layoffs need 90 days’ written notice. Contractors must offer available jobs to qualified laid‑off staff and give benefits comparable to the district’s. Bids must list job counts, titles, and wages. They must show equivalent liability insurance and a GAAP cost forecast for at least 3 years. If accepted, the contractor cannot charge more than that forecast. The board must publish its own GAAP cost comparison, review bids in an open meeting, and hold at least one public hearing with advance notice (at bid time or at least 30 days before, whichever is more). Contractors must certify criminal background checks were done within the past 3 months and share results if asked, and they must follow equal‑opportunity rules. Services already outsourced on July 1, 2026, stay under their current contracts and are not subject to these new steps.

Short emergency outsourcing for school support

Beginning July 1, 2026, a school board can hire a third party for up to 3 months in an emergency that threatens student or staff safety. Before using this, the board must meet labor‑law duties and post all covered vacancies for the full contract period. After two emergency uses for the same group, the board must hold a public hearing or get union agreement. After three or more, mutual agreement with the union is required. Any agreement cannot reopen the union contract and must include a recruitment and retention plan with a timeline, reasons, job details, targeted ads, comparable pay and benefits, and any incentives.
