More counties adopt police merit systems

Counties that already have a police merit board or sheriff merit commission must use the State merit system. Counties with 75,000 to 999,999 people without a board may adopt it by ordinance. Counties under 75,000 may adopt it, or voters can force a vote with signatures from 5% or 1,000 registered voters, whichever is less. Counties over 1,000,000 are exempt, and places that do not adopt are not covered.

Agencies share full police personnel files

When one law‑enforcement agency checks a job applicant, the other agency must send the complete personnel file with a signed release. The file must arrive within 14 days (one 14‑day extension is allowed) with a signed statement that it is complete and that no other negative information is known. Files are shared without redactions except sensitive IDs, and any NDA or settlement that blocks sharing is void; court‑sealed records stay protected but must be noted. The law defines a personnel file broadly, including performance, discipline, training, investigations, and hiring background materials. For other third‑party releases, employers still remove discipline records older than four years unless the law or a court requires release. Agencies that share files under this section are immune from suit, and existing union contracts that were already in effect still control where they conflict.

Stronger background checks before police hiring

The law requires police and other law‑enforcement applicants to sign a release before a final job offer. The release lets prior employers share full employment and investigation records, including fitness exams and discipline. Prior employers must respond in 14 days (one 14‑day extension allowed) and certify the records are complete. Records are not redacted except for Social Security, tax ID, driver ID, and bank or card numbers; NDAs cannot block release. Hiring agencies must review the records first, may have to pay reasonable production costs, and can go to court to compel and recover fees. Good‑faith producers have immunity; current union contracts still control where they conflict; a State’s Attorney can direct non‑production; a model consent form is provided.
