Kaskaskia port expands with new board

The law creates the Kaskaskia Regional Port District for Monroe, Randolph, and parts of St. Clair Counties. Its main office is in Red Bud, Illinois. It folds the Southwest Regional Port District into Kaskaskia and repeals the Southwest law. The transfer of assets, contracts, records, and unspent funds must finish by December 1, 2025. The Board has 15 unpaid members: 8 from St. Clair, 4 from Randolph, and 3 from Monroe. Members are reimbursed for expenses, and a secretary or treasurer may be paid. The Governor appoints members with Senate approval. The terms of members appointed by the Governor as of May 1, 2025 end when this Act takes effect, and new appointees serve 3-year terms. District property cannot be seized to satisfy judgments unless it was pledged as collateral for a bank loan.

Port can run water and sewer

The District can build, own, lease (up to 99 years), and operate water, sewer, and other utility systems. It can charge reasonable fees to users. The District cannot provide these services if an investor‑owned utility will do so. That utility must reply in writing within 30 days after a written request from the District.

Bonds fund projects, users cover costs

The District can borrow and issue general obligation and revenue bonds to build and run port and related facilities. Revenue bonds are paid only from facility revenues, can run up to 40 years, and interest rates follow state caps. Temporary bonds are allowed. When it issues revenue bonds, the Board sets user rates and fees high enough to cover operations and all bond payments. The District may use trust agreements to secure bonds, but no lien can be placed on District physical property. Remedies can include mandamus as stated in the agreement.
