Sellers (or their agent) must list their name, address, and phone in the contract. They must tell buyers about any mortgage, lien, easement, or other encumbrance they know about. If they know, they must also state they own the items, have authority to sell them, and believe they were lawfully obtained.
The contract must include an estimated advertising cost the seller will pay. If actual ad costs go over 120% of that estimate, the auctioneer pays the extra unless the seller agrees in writing to pay it. This protects sellers from surprise bills.
Auctioneers and auction firms must have a written contract with the seller before the auction. The contract must say if the sale is with reserve or absolute. It must list the auctioneer’s name, license number, business address, and phone. It must show the auctioneer’s fee and any buyer premium, and say who gets the premium. Both the auctioneer and the seller (or the seller’s agent) must sign.
