Staff and equipment move to State Police

On Jan. 1, 2026, staff who run motor carrier safety programs transfer to the Illinois State Police. Staff must pass background checks and screening before the move. Employees keep their job status, pensions, and bargaining rights; Motor Carrier Safety Assistance Program union staff keep current rights through Oct. 1, 2026. On the same date, vehicles, computers, uniforms, and other gear bought with federal motor carrier grants become State Police property.

State Police fund for truck safety

Beginning Oct. 1, 2025, a special State Police fund can receive fees, court assessments, grants, donations, and other revenue. The money pays for police escorts and commercial-vehicle enforcement. Investment earnings stay in the fund, and spending needs approval by the General Assembly. Starting the same date, civil penalties for certain motor carrier violations go into the State Police Operations Assistance Road Fund. The State Police complete hearings for newer cases; older cases stay with Transportation.

State Police take over truck safety

Beginning Oct. 1, 2025, the law names the Illinois State Police as the lead agency for motor carrier safety rules. Only the State Police may stop and inspect commercial trucks and drivers to check compliance. The State Police are the sole enforcers of these rules against drivers and others. An interagency agreement is required to set roles for enforcing Chapter 18B. The law also updates references so the State Police administer hazardous materials transport rules in Illinois.

State rules for propane storage and sales

Beginning Oct. 1, 2025, the State Fire Marshal sets and enforces rules for storing, hauling as cargo, selling, dispensing, and using propane (not as school bus fuel). Cities cannot enforce local rules that conflict with state rules. Cities can still regulate the location and operation of large bulk plants and storage over 1,200 gallons. The State Police keep control of some transport rules under the Hazardous Materials Transportation Act.

Emergency hours relief for utility drivers

Beginning Oct. 1, 2025, CDL holders who work for utilities can drive past normal hours during a declared utility outage emergency. The Illinois Department of Transportation must declare the emergency when a utility notifies it. The break lasts while giving direct help or up to 5 days, whichever is shorter. The state can deny future requests if a provider abuses the process. The rule cannot risk federal funding.
