Illinois pays public school tuition for eligible resident children from homes for orphans, dependents, abandoned, or maladjusted children, and for children living in districts with State‑run welfare or penal housing. The payment equals eligible students in average daily attendance times 1.2 times the district’s per‑student cost. That per‑student cost uses last year’s allowed school funds minus State and federal offsets and non‑K–12 items, plus depreciation. If a home’s education allowance does not cover the bill, the State pays the difference. If a district lacks space and assigns students to a nearby district, the State pays that adjacent district.
For students under the State’s legal guardianship or custodianship, districts can claim documented costs above 1.2 times the district per‑student tuition. Planned services must be coordinated with the State agency or group home, and costs must follow rules set under this law.
If a home gets a parent, guardian, or court‑ordered allowance for a child’s schooling, it must pay that amount to the school board, up to the district tuition. If a child who is not an Illinois resident is placed in a listed facility or program, the placing agent must assure payment for that child’s tuition and related services.
Through June 30, 2030, some districts tied to military bases must leave out certain building depreciation when the State figures per‑student cost. This applies only if the district is Tier 1 or 2, has at least one school on federal property, enrolls 2,500–4,500 students, and receives a federal Public Schools on Military Installations grant. The excluded depreciation is for parts of new buildings paid with federal, donated, or privately donated funds and does not change maintenance, operations, or later projects paid with other funds. Leaving out depreciation can lower tuition reimbursements.
Districts must certify regular claims by June 15 and summer claims by November 1; summer vouchers go to the Comptroller by December 15. The State vouches estimated payments on September 30, December 31, and March 31, and pays amounts due on or before August 31. Claims received by June 15 can be amended until August 1. If funds were short, unpaid amounts are paid on August 31 of the next year before current‑year claims. Districts may not claim the same child twice under different programs.
