Operators must keep a surety bond that is the greater of $100,000 or 100% of the monthly Illinois transaction value (based on the most recent quarter), capped at $2,000,000. Operators must also keep tangible net worth of at least the greater of $100,000 or a sliding percentage of assets: 3% of the first $100 million, 2% of the next $900 million, and 0.5% above $1 billion. The Secretary may grant exemptions.
Kiosks must show clear prices, fees, risks, and refund steps before each transaction and give you a detailed receipt. Live customer service is required during operating hours, with a toll‑free number on the kiosk. Operators must keep a written anti‑fraud policy and use blockchain analytics to block known scam wallets. If you were fraudulently induced, you can get a full refund by contacting the operator within 30 days and filing a police or government report within 60 days. New customers can get refunds for up to three fraudulent transactions in their new‑customer period. The state posts kiosk locations and operator contacts, and operators must keep a monitored phone or email for law enforcement. If a kiosk breaks the rules on daily limits, fee caps, or refunds, you can sue and recover reasonable attorney’s fees and court costs if you win.
This law applies to any digital asset kiosk in Illinois. The Department can write rules, register or revoke operators, subpoena records, examine books, and hold hearings. The Secretary can issue cease‑and‑desist orders before a hearing, and the operator can request a hearing within 10 days. The Secretary, through the Attorney General, can seek court orders to stop violations and treat deals made to evade the law as covered. The Secretary can fine up to $25,000 per count (up to $75,000 for certain violations), order restitution, and suspend a registration for up to 180 days in emergencies. Some government and insured financial entities are exempt, and the Department can grant other exemptions. Listed sections are repealed on the date SB 1797 becomes law.
Each registration application must include a nonrefundable $5,000 fee. For exams, operators pay $150 per examiner hour (or part of an hour) plus travel costs. Operators also pay a yearly pro rata assessment based on their share of Illinois kiosk transaction value. These receipts go into the Digital Asset Kiosk Fund to run the program. The Fund section is repealed if SB 1797 becomes law.
This law limits how much you can buy or sell at a kiosk each day. New customers are capped at $2,500 a day. Existing customers are capped at $10,500 a day. It also caps what kiosks can charge per transaction at the greater of $5 or 18% of the transaction value, based on the market price when you start.
You must register with the Department to operate a digital asset kiosk in Illinois. The application requires principals’ backgrounds, audited financials, disclosures, AML statements, and a surety bond. The Secretary can deny registrations that do not protect the public; you can request a hearing. You must renew each year by December 1 and report material changes. Operators active on the law’s effective date are not required to register until July 1, 2027.
