The law defines low-level radioactive waste as anything that is not high-level waste, spent fuel, transuranic waste, or certain Atomic Energy Act byproducts. This state definition applies even if a regulator says a material is exempt. The law also defines a disposal or treatment facility and makes clear a generator’s production site is not a facility under this Act.
You do not have to register if the material’s half-life is under 120 days and you hold it until at least 10 half-lives pass before normal disposal or recycling. Generators of water treatment residuals are also exempt if combined radium is 200 picocuries per gram or less and they are registered under the Agency’s water treatment program. These exemptions only remove the registration step; all other state and federal rules still apply.
Generators of any low-level radioactive waste must register with IEMA‑OHS within 60 days of starting. Brokers who take possession must also register within 60 days. Registered generators and brokers must file a yearly report on types and amounts handled, how the waste was managed, and where shipments went, including expected future amounts and alternatives considered. These registrations and reports are public under the Freedom of Information Act.
