Stricter timber hauling rules and penalties

The law updates timber transport rules and key definitions. Timber does not include firewood or Christmas trees. Proof of ownership can be digital. If you haul two or more trees on an Illinois highway, you must carry proof of ownership. Interstate haulers starting outside Illinois can use federal motor carrier documents. Keep the proof with the load and show it on request. Do not give false information. Obey lawful orders from officers. Officers can stop and inspect vehicles hauling timber and issue a court summons for violations. Penalties are tougher: any violation of the Act or its rules is a Class A misdemeanor. The Department can seize timber, tools, and vehicles used in violations. If no owner is found in six months, it sells the property and deposits the money in the Illinois Forestry Development Fund. You can reclaim property before sale by proving ownership and paying custody costs. Timber transport violations now count as conservation offenses for assessments, except those punishable by penitentiary imprisonment. The Department sets what information the proof must include by rule. The law also repeals several old sections of the prior statute.

Neighboring officers can enforce in Illinois

The Department director can let conservation officers from neighboring states act in Illinois. When authorized, they have the same powers as Illinois Conservation Police. They can follow, seize, and return plants or animals taken in violation of the other state’s law, under Illinois supervision. They can also enforce listed Illinois conservation laws. Illinois does not pay them and is not liable for their actions. This authority applies only when the Director grants it.
