Faster timelines and notices for city bonds

Cities and other local governments must hold a bond election within 60 days after legal steps are met, or within 90 days if that longer window includes a primary, general, or special election day. They must publish a notice in a local newspaper once a week for two weeks, with the first at least 21 days before the vote. If the county election office has a website, it must post the notice until the day after the election. The notice must list the time, place, and purpose and be signed by the county election officer.

Limits on school bond election dates

School districts and community junior colleges may not hold more than one special bond election in a year. They can hold additional bond votes when the election falls on a primary or general election day or at a board member election. No special bond election can occur within 60 days before or after a general or board election. Capital outlay tax levies are not covered, and emergency repair or replacement bonds are allowed with State Board of Education approval. For school officer elections, any vote on the first Tuesday after the first Monday in March, or on the same day as a general or primary, counts as a special election.

New timing rules for ballot questions

Most ballot-question elections cannot be on the same day as another election for the same voters. Mail-ballot elections under state law and elections on the first Tuesday after the first Monday in March are allowed. The election must be nonpartisan and cannot elect, retain, or recall a candidate. For these elections, the governing body and county election officer agree on the date within 120 days, and the Secretary of State approves a written plan.

Standard dates for special elections

The law bars special elections within 45 days of a general or primary election. A special election may be held on the same day as a general or primary. It may also be held on the first Tuesday after the first Monday in March. These rules apply statewide to officials who call and run special elections.
