New crimes for telecom trespass and damage

The law protects telecom and video service gear, including above- and below-ground lines, cables, and wires. Entering a fenced or clearly posted facility or its property without consent is a class A misdemeanor. Doing so with intent to damage or stop operations is a severity level 7 felony. Knowingly damaging or tampering with a facility is a severity level 6 felony. If done to impede operations, it is a severity level 5 felony.

Owners can also sue for damage

The law keeps other legal options for facility owners after damage. Owners can sue for losses or seek other remedies. People who break these rules can also be charged under other Kansas crimes, including article 58 of chapter 21 and K.S.A. 66-2303.
